Part A — Your professional use of TrustyDr Healthcare
1. Introduction and acceptance
These Terms of Service ("Terms") govern your access to and use of TrustyDr Healthcare as a provider — a doctor, or a staff member of a medical center, pharmacy, or laboratory/imaging facility ("Provider," "you," your) — operated by TrustyDr ("we," "us").
"App," "Appointment," and "Account" carry the same meanings given to them in the Patient Terms of Service. In this document, "Provider" means you personally — the individual doctor or staff member using the App in a professional capacity. The Patient Terms of Service use "Provider" more broadly, to include the facility a patient books with; that broader use and this document's individual-level use both describe the same professional side of a Healthcare interaction, at two different levels — the facility, and the individual people, like you, who act for it.
Before you can use protected features of the App, you must electronically accept the current version of these Terms and our Privacy Policy. Your acceptance is recorded and version-tracked by our systems, and you may be asked to review and accept again if we publish a materially updated version.
These Terms are provided in English, Arabic, and Kurdish. Each version is intended to convey the same meaning; if you have any question about a difference between versions, please contact us using the details in Section 13.
Where you are staff of, or the owner of, a medical center, pharmacy, or laboratory/imaging facility, that facility's own use of TrustyDr Healthcare — and its own obligations toward TrustyDr — are governed by the applicable Medical Center Agreement, Pharmacy Agreement, or Lab/Imaging Agreement, which is separate from and additional to these Terms.
2. Eligibility, licensing, and credential accuracy
You represent and warrant that you hold every license, registration, and qualification required by Iraqi law to practice your profession or perform your role, and that you will maintain them for as long as you use the App. This includes, for a doctor, registration with the Iraqi Medical Association/Syndicate and any Ministry of Health licensing requirement.
You agree that the professional information you provide (specialty, qualifications, facility affiliation, availability, pricing) is accurate and kept up to date. TrustyDr reserves the right to verify, or require you to demonstrate, your licensing or professional status at any time, and to restrict your visibility or access on the App pending that verification. We do not represent that a specific verification process, standard, or timeline currently applies to every provider.
3. Independent clinical judgment and responsibility
You are an independent professional. TrustyDr does not practice medicine, does not make or review clinical decisions, and has no role in your diagnosis, treatment, or prescribing. You are solely responsible for the clinical judgment you exercise, the accuracy and completeness of any record you create through the App, and compliance with every professional and legal obligation that applies to your practice, whether or not specifically referenced in these Terms.
Medical errors. Iraqi law recognizes liability for medical errors, including under the Penal Code — for example, a medical error resulting in death (imprisonment of one to five years) or permanent injury or disability, and general criminal responsibility for negligence, lack of due care, or acting without the patient's (or their legal representative's) consent. Nothing in your use of TrustyDr Healthcare changes, narrows, or substitutes for these obligations, and TrustyDr bears no responsibility for your compliance with them.
4. Remote and virtual communication with patients — Medical Disclaimer
TrustyDr Healthcare is a scheduling, discovery, and communication platform. It does not provide medical advice, diagnosis, or treatment, and nothing about the App changes what care is appropriate to give remotely versus in person — that determination is yours alone, exercised under the same professional standards that would apply in any other setting.
Iraq currently has no dedicated telemedicine or digital-health law: general medical-licensing and liability rules apply by default to remote or virtual communication with a patient exactly as they would to an in-person encounter. You are solely responsible for deciding whether a given case is appropriate to handle remotely, for the accuracy of any advice, note, or prescription you give or record through the App, and for recognizing the limits of what can safely be assessed without an in-person examination. You must not use TrustyDr Healthcare to provide care in circumstances that require in-person examination, emergency treatment, or a higher level of care than a remote communication channel can support.
5. Patient data handling obligations
Through the App, you may access patient information necessary to provide care (for example, a patient's contact details, appointment history, or notes you or another provider have recorded). You agree to: use that information only for the purpose of providing care to that patient or administering your practice; handle it consistent with your professional duty of confidentiality and applicable Iraqi law — including the general prohibition on disclosing confidential information obtained through your professional duties, and on disclosing private or family information — and not use it for unrelated purposes or share it with third parties without a lawful basis; and notify us and, where required, affected patients promptly if a security incident involving that data occurs on your side.
6. Acceptable use
You agree not to use the App to: violate applicable law or your professional obligations; misrepresent your identity, licensing, or qualifications; interfere with the operation or security of the App; attempt to gain unauthorized access to any account or system; or submit false, fraudulent, or misleading information, including about your availability, pricing, or a patient's booking.
Because Iraq does not currently have an enacted cybercrime statute, our practical remedies for misuse of the App rest primarily on this Agreement — including account suspension or termination and pursuit of civil remedies — rather than on a criminal-law backstop.
7. What TrustyDr Healthcare is — platform-role characterization
TrustyDr Healthcare is a technology platform. We provide scheduling, discovery, and communication infrastructure; we are not your employer (unless separately and expressly agreed in writing), your medical malpractice insurer, your professional regulator, or a party to the care relationship between you and any patient.
8. Fees
Where TrustyDr charges a fee for use of the App (directly to you, or to a facility you are affiliated with, as described in the applicable facility agreement), that fee is separate from any amount you charge patients for your own services.
9. App availability and changes
We may modify, suspend, or discontinue any part of the App at any time. We do not guarantee that the App will be available uninterrupted or error-free.
10. Disclaimers and limitation of liability
The App is provided "as is." We make no warranty regarding patient volume, business outcomes, or the fitness of the App's tools for your specific practice. To the maximum extent permitted by law, TrustyDr's total liability to you arising out of or relating to your use of the App is limited to any fees you have actually paid directly to TrustyDr in the six months before the claim arose. This limitation does not apply to liability that cannot be limited under applicable law, including liability for fraud or gross negligence, and does not limit your own liability to a patient for the care you give, which is between you and the patient.
11. Suspension and termination
We may suspend or terminate your access to the App for violation of these Terms, fraud, loss of the licensing represented in Section 2, or conduct that creates legal or security risk for the App or its users.
12. Governing law and dispute resolution
These Terms are governed by the laws of Iraq. Any dispute will be subject to the jurisdiction of the competent Iraqi courts.
13. Changes and contact
We may update these Terms from time to time. Where a change is material, you will be asked to review and accept the updated Terms before continuing to use protected features of the App.

Part B — Marketplace / Commerce participation
This Part B applies only where you personally use TrustyDr Marketplace features — for example, browsing or ordering products as an individual, or acting as staff of a facility that sells on the Marketplace. It does not apply if you never use those features. "Marketplace" and "Store" carry the same meanings given to them in Part B of the Patient Terms of Service.
14. If you personally buy on the Marketplace
If you place your own orders through the Marketplace, you do so as a buyer, on the same terms given to a patient under Part B of the Patient Terms of Service: orders are a request to purchase, subject to the Store's acceptance; payment is made directly between you and the Store, not through TrustyDr; delivery is the Store's responsibility; and non-conforming products may be returned or refunded through the Store, consistent with Iraqi consumer-protection law.
15. If you act as staff for a facility that sells on the Marketplace
Where your facility (a medical center, pharmacy, or lab/imaging facility) participates in the Marketplace, your own access to Marketplace tools (managing listings, accepting or fulfilling orders, viewing customer information) is granted to you by that facility, and is governed by its own Medical Center Agreement, Pharmacy Agreement, or Lab/Imaging Agreement, as applicable. As an individual, you agree to: enter accurate information when using those tools; never fabricate, alter, or manipulate an order, price, or inventory record; and handle any customer information you access through those tools only for the purpose of fulfilling orders, consistent with your facility's own data-handling obligations and Section 5 of Part A above.
TrustyDr is not a party to the sale between your facility and its customers, is not your facility's payment processor, and does not operate a delivery fleet — the same platform-role characterization given in Section 7 of Part A applies equally to Marketplace activity.
